Duties, Appointment and Dismissal of the Public Administrator

(1) At the level of communes, towns, municipalities, and counties, the mayor or, as the case may be, the president of the county council may propose to the local council or the county council, as applicable, the establishment of a managerial position of public administrator, within the limits of the maximum number of approved positions.

(2) Persons eligible to occupy the position of public administrator must generally have completed higher education in economics, administration, technical fields, or law.

(3) Appointment to the position of public administrator is made by an order of the mayor or the president of the county council, as applicable, which includes as an annex a management contract in compliance with the specific requirements provided in Article 543.

(4) The management contract is concluded between the mayor or, as the case may be, the president of the county council and the public administrator for a fixed term. The duration of the public administrator’s management contract may not exceed the term of office of the mayor or the president of the county council, under whose mandate the administrator was appointed.

(5) Based on the management contract, the public administrator may perform duties related to coordinating various departments within the specialized administrative structure or public services of local or county interest, as applicable.

(6) The mayor or, as the case may be, the president of the county council may delegate to the public administrator, under the law, the capacity of principal authorizing officer (chief budget manager).

(7) The position of public administrator is exempted from the 12% quota allocated to managerial positions as stipulated in Article 391.

(8) Dismissal from the position of public administrator is carried out by order of the mayor or, as the case may be, the president of the county council, and occurs in the following situations:
a) upon the expiration of the management contract duration;
b) as a result of a final conviction for any of the offenses provided in Article 542, paragraph (1), letter f);
c) if the public administrator fails to fulfill the obligations established in the management contract;
d) in other situations provided by law.

(9) The provisions of paragraphs (1)–(8) apply accordingly to administrative-territorial subdivisions.
